PERSONAL DATA PROTECTION POLICY
General Provisions
- The management of this site https://elan.net.ua/ (hereinafter referred to as the «Site») is carried out by an Individual Entrepreneur Ruban Yurii Heorhiiovych, acting on the basis of an extract from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations (hereinafter — Sole Proprietor).

The Sole Proprietor has great respect for the confidential (personal) information of all persons, without exception, who have visited the Site, as well as those who use the services provided by the site. In this regard, the Sole Proprietor strives to protect the personal data confidentiality (information or a set of information about an individual who is identified or can be specifically identified), thereby creating and providing the most comfortable conditions for using the Site's services for each user.

This Personal Data Protection Policy (hereinafter referred to as the «Policy») establishes the procedure for the Sole Proprietor to process personal data, the types of personal data that are collected, the purposes of using such personal data, the Sole Proprietor’s interaction with third parties, security measures to protect personal data, conditions for accessing personal data, as well as contact information for the user about gaining access, making changes, blocking, or deleting their personal data and addressing any questions that you may have regarding the practice of protecting personal data.
Collection and use of personal data
1. The individual entrepreneur Ruban Yurii Heorhiiovych is the site users’ personal data owner and processor.
2. When the user uses the services of the Sole Proprietor’s website, the user's data is processed, namely:
— data provided by the user both when filling out registration forms and in the process of using the services;
— cookies;
— IP address;
— settings of Internet browsers (User-agent).3. The Sole Proprietor collects only those personal data (for example, your first name and last name, access login and password, e-mail address, contact phone number, date of birth, gender, etc.) that you as a personal data subject deliberately and voluntarily provide for the purposes of using the Site services, which, in accordance with the legislative requirements, is the personal data subject’s consent to process their personal data in accordance with the purpose of their processing formulated in this Policy.
4. When visiting the Site, all logins are recorded. Other information about user traffic is not processed or stored.
5. Please note: the Sole Proprietor confines herself to collecting the minimum amount of information necessary solely to fulfill the personal data subject’s request. In any case, when optional information is requested, the user will be notified at the time such information is collected.

The Sole Proprietor does not collect any information for the processing of which certain requirements are established by law, such as information on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, convictions to criminal punishment for committing a crime or conviction to a criminal punishment, as well as data related to health, sexual activity, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine «On Personal Data Protection»).
7. The Sole Proprietor collects data on the statistics of the Site visits. The information may contain connections, traffic, the user's browser, as well as the date, time, duration of surfing the web and staying on the Site.
Personal data processing
1. The processing and storage of the provided personal data is carried out in data centers where the equipment is located that ensures the functioning of the Site’s services. The provided personal data is processed and can be stored in the Personal Details Database or in a separate table of the Site Database.
2. The place of the personal data storage and processing is located at the address: Kyiv, 40B Revutskogo Street, Lebedynyi Residential Complex.
Purposes of using personal data
1. Your personal data is used to ensure providing of the Site’s Internet services, exchanging information, relations in the field of advertising and communication in accordance with and in pursuance of the laws of Ukraine, including, but not exclusively: «On Personal Data Protection», «On Ratification of the Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data and the Additional Protocol to the Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data regarding supervisory authorities and transborder data flows»,«On Information»,«On Advertising»,«On Telecommunications»,«On Information Protection in Information and Telecommunication Systems»,«On State Support for the Media and Social Protection of Journalists», as well as in accordance with the Site Use Rules and other acts regulating the Sole Proprietor activities.
Personal data retention period
1. Personal data is stored for no longer than is necessary for the purpose of processing it.
2. After the personal data subject stops being a user of the Site by deleting an account on the Site, their personal data is also automatically deleted.
Security of minors
1. The Site is not intended for minors. The Sole Proprietor takes security-related issues very seriously, especially those related to persons under the age of majority, and accordingly, on her part, the Sole Proprietor calls on parents to tell their children about web security problems, about their specific purpose and the need to use those or other services of the Site.
Sole Proprietor’s interaction with third parties regarding personal data
1. The Sole Proprietor does not transfer personal data to third parties, unless such transfer is required by law, at the request of the personal data subject, or in other cases set out in this Policy. The Sole Proprietor understands that personal information is a value and inalienable content, including the personal non-property rights of any individual, so the Sole Proprietor takes all possible measures to secure the users’ personal information, voluntarily and deliberately transferred by the latter to the Sole Proprietor.
2. The Site may contain links to other websites (for informational purposes only). If you click on a link to other websites, this Policy will not apply to such websites. In this regard, the Sole Proprietor recommends leafing through the personal data protection policy of each site before transferring personal data you can be identified by.
Personal data security
1. The Sole Proprietor uses generally accepted standards of the information and personal data technological and operational security from loss, misuse, alteration, or destruction. However, despite all efforts, the Sole Proprietor cannot guarantee absolute security from any threats that arise beyond the Sole Proprietor’s control.
2. The Sole Proprietor ensures applying all relevant confidentiality obligations, as well as technical and organizational security measures to prevent unauthorized or illegal disclosure or processing of such information and data, their accidental loss, destruction, or damage.
3. The Sole Proprietor provides access to information and personal data only to authorized employees who have agreed to ensure the confidentiality of such information and data in accordance with the Sole Proprietor’s requirements.
4. Dissemination of personal data without the consent of the personal data subject or a person authorized by them is allowed in cases determined by law, and only (if necessary) in the interests of national security, economic welfare, and human rights.
Terms of access to personal data
1. The procedure for accessing personal data by third parties is determined by the terms of the user's consent provided to the personal data owner for processing this data, or in accordance with the law.
2. The user has the right to get any information about themselves from any party to a relationship related to personal data, provided that the last name, first name and patronymic, place of residence (place of stay), and particulars of the document identifying the individual submitting the request are indicated, unless otherwise provided by law.
3. User access to personal data is free of charge.
4. The deferral of the user's access to their personal data is not allowed.
5. The deferral of the third parties’ access to personal data is allowed if the necessary data cannot be provided within thirty calendar days from the date of the request. At the same time, the total period for resolving the issues raised in the request cannot exceed forty-five calendar days.
6. The deferral notice is brought to the attention of the third party who submitted the request, in writing, explaining the procedure for appealing such a decision.
7. The decision to defer or deny access to personal data can be appealed to the Human Rights Commissioner of the Verkhovna Rada of Ukraine or the court.
Rights of the personal data subject
1. The Sole Proprietor informs you as a personal data subject about your rights that are regulated by the Law of Ukraine «On Personal Data Protection», namely:
- know about the sources of collecting, the location of your personal data, the purpose of their processing, the location or place of residence (stay) of the personal data owner or processor, or to encharge persons authorized by them an appropriate task to get this information, unless otherwise provided by law;
- receive information about the conditions for providing access to personal data, including information about third parties to whom their personal data is transferred;
- to access their personal data;
- to get an answer about the processing of their personal data no later than thirty calendar days from the date request, unless otherwise provided by law, as well as get the content of such personal data;
- to make a reasoned demand to the personal data owner with an objection to proceed their personal data;
- to make a reasoned demand to change or destroy their personal data by any personal data owner and processor, if these data are processed illegally or are unreliable;
- to protection of their personal data from illegal processing and accidental loss, destruction, or damage due to deliberate concealment, failure to provide or delays in providing them, as well as to protection against providing information that is unreliable or disgracing the individual’s honor, dignity, and business reputation;
- to file complaints about processing their personal data with the Human Rights Commissioner of the Verkhovna Rada of Ukraine or the court;
- to apply legal remedies in case of violating the legislation on the personal data security;
- to make reservations about limiting the right to process their personal data when giving consent;
- to withdraw consent to the personal data processing;
- to know the mechanism of the personal data automatic processing;
- to protection from an automated solution that has legal implications for it.
2. To update, gain access, amend, blockб or delete your personal data, withdraw consent to processing personal data that you provided to the Sole Proprietor in accordance with this Policy, or in case of any comments, requests, or claims regarding your personal data processed by the Sole Proprietor, please contact the Sole Proprietor by e-mail or send a letter to the address: 02068, Kyiv, 40B Revutskogo Street, Lebedynyi Residential Complex.
Policy change
1. Changes and additions may be made to this Policy from time to time and without prior notice to the user, including when legal requirements are amended.
2. In the case of significant changes to this Sole Proprietor’s Policy, a notice will be posted on the Site and the date of these changes entry into force will be indicated. If, within the specified period, you do not refuse to accept them in writing, this means that you agree with the corresponding changes in the Policy.
